These Terms and Conditions, together with any policies referenced herein (collectively, these "Terms of Service" or "Terms"), describe your rights and responsibilities when you access or use our Services

We do not warrant that the appearance, fit, or quality of any products purchased by you will meet your expectations or be exactly the same as depicted on our online store. Product images are for illustrative purposes only.

All descriptions of products, including sizes, colors, materials, and designs, are subject to change at any time without notice at our sole discretion. We reserve the right to discontinue any product at any time and may limit the quantities of any products offered, on a case-by-case basis.

SECTION 3 - ORDERS AND PRICING

When you place an order, you are making an offer to purchase. Cool Bee reserves the right to accept or decline your order for any reason at its sole discretion. Your order is not accepted until Cool Bee confirms acceptance via email or SMS. We must receive and process your payment before your order is accepted.

Please review your order carefully before submitting. Cool Bee may be unable to accommodate cancellation requests after an order is accepted. In the event that we do not accept, modify, or cancel an order, we will notify you by contacting the email address, billing address, and/or phone number provided at the time the order was placed.

Pricing and GST: All prices displayed on our website are in Indian Rupees (INR). Unless otherwise expressly stated, posted prices include applicable Goods and Services Tax (GST), shipping charges, or handling fees. You agree to provide current, complete, and accurate purchase, payment, and account information for all transactions. You represent and warrant that

(i)  The payment information you provide is true, correct, and complete,

(ii)  You are duly authorized to use such payment method,

(iii)  Charges incurred by you will be honoured by your payment provider, and

(iv) You will pay all charges at the posted prices, including applicable GST, shipping, and handling charges.

SECTION 4 - RETURN, EXCHANGE, AND REFUND POLICY

As per the Consumer Protection (E-Commerce) Rules, 2020, we are committed to providing transparent return, exchange, and refund policies.

Return Window: You may return or exchange products within 07 days from the date of delivery for garments and clothing items, subject to the conditions mentioned below.

Conditions for Return/Exchange:

  • Products must be unused, unwashed, and in their original condition with all original tags, labels, packaging, and barcodes intact.
  • Products sold during End of Season Sales (EOSS) or marked as "Final Sale" may have different return policies, which will be clearly indicated at the time of purchase.
  • Intimate wear, innerwear, and undergarments cannot be returned or exchanged for hygiene reasons. Accessories, if sold as part of a combo or set, cannot be returned individually.

Defective or Damaged Products: If you receive any damaged, defective, or significantly different product from what was ordered, you must notify us within 48 hours of delivery. We will arrange for a return pickup and provide a full refund or replacement at no additional cost to you.

Refunds: Refunds will be processed within 3-7 business days from the date we receive the returned product, as per Reserve Bank of India (RBI) guidelines. Refunds will be credited to the original payment method used at the time of purchase.

No Cancellation Charges: We do not charge cancellation fees if you cancel your order after confirmation, in compliance with E-Commerce Rules, 2020.

SECTION 5 - SHIPPING AND DELIVERY

We ship our products across India. Delivery times are estimates only and are not guaranteed. We are not liable for shipping and delivery delays caused by shipping carriers, customs processing, natural disasters, strikes, or events beyond our reasonable control.

All delivery times displayed on our website are approximate and may vary based on your location and other factors. Once we transfer products to the carrier for delivery, the risk of loss passes to you.

We will provide you with tracking information via email or SMS once your order has been dispatched.

SECTION 6 - INTELLECTUAL PROPERTY

Cool Bee's name, logos, product names, designs, and slogans are trademarks of Cool Bee and may not be used without our prior written permission. All rights not expressly granted herein are reserved by Cool Bee.

Our Services may contain links to third-party websites or provide access to third-party tools, such as payment gateways, logistics services, or social media platforms. We do not monitor, control, or endorse these third-party websites or tools.

TO THE FULLEST EXTENT PROVIDED BY INDIAN LAW, IN NO CASE SHALL COOL BEE, OUR PARTNERS, DIRECTORS, OFFICERS, EMPLOYEES, AFFILIATES, AGENTS, CONTRACTORS, SERVICE PROVIDERS, OR LICENSORS BE LIABLE FOR ANY INJURY, LOSS, CLAIM, OR ANY DIRECT, INDIRECT, INCIDENTAL, PUNITIVE, SPECIAL, OR CONSEQUENTIAL DAMAGES OF ANY KIND, INCLUDING, WITHOUT LIMITATION, LOST PROFITS, LOST REVENUE, LOST SAVINGS, LOSS OF DATA, REPLACEMENT COSTS, OR ANY SIMILAR DAMAGES, WHETHER BASED IN CONTRACT, TORT (INCLUDING NEGLIGENCE), STRICT LIABILITY, OR OTHERWISE, ARISING FROM YOUR USE OF ANY OF THE SERVICES OR ANY PRODUCTS PROCURED USING THE SERVICES, EVEN IF ADVISED OF THEIR POSSIBILITY.

In the event that any provision of these Terms of Service is determined to be unlawful, void, or unenforceable under Indian law, such provision shall nonetheless be enforceable to the fullest extent permitted by applicable law, and the unenforceable portion shall be deemed severed from these Terms of Service. The failure of Cool Bee to exercise or enforce any right or provision of these Terms of Service shall not constitute a waiver of such right or provision.

These Terms of Service, together with our Privacy Policy, Refund and Return Policy, and any other policies posted on our website, constitute the entire agreement between you and Cool Bee and govern your use of the Services, superseding any prior or contemporaneous agreements, communications, or proposals between you and us.

SECTION 19 - ASSIGNMENT

You may not delegate, transfer, or assign this Agreement or any of your rights or obligations under these Terms without our prior written consent, and any such attempt will be null and void. We may transfer, assign, or delegate these Terms and our rights and obligations without consent or notice to you.

These Terms of Service and any disputes arising out of or related to these Terms or your use of the Services shall be governed by and construed in accordance with the laws of India, including but not limited to the Indian Contract Act, 1872, the Consumer Protection Act, 2019, the Information Technology Act, 2000, and other applicable Central and State laws.

Jurisdiction: You and Cool Bee consent to the exclusive jurisdiction of the courts located in Gautam Buddh Nagar District, Noida, Uttar Pradesh, India for the resolution of any disputes arising out of or relating to these Terms or the Services.

Consumer Rights: Nothing in this Section shall limit your rights under the Consumer Protection Act, 2019, to file complaints with the appropriate Consumer Disputes Redressal Commission.

SECTION 21 - CHANGES TO TERMS OF SERVICE

We reserve the right, in our sole discretion, to update, change, or replace any part of these Terms of Service by posting updates on our website. It is your responsibility to check our website periodically for changes.

We will notify you of any material changes to these Terms in accordance with applicable law, and such changes will be effective on the date specified in the notice. Your continued use of or access to the Services following the posting of any changes constitutes acceptance of those changes.
